Forceful Intimidation Because Of Race

Title 42, U.S.C., Sec. 3631, makes it a Federal crime or offense for anyone, by force or threat of force, to willfully intimidate or interfere with someone because of his or her race and because he or she has been occupying any dwelling.

A person can be found guilty of that offense only if all of the following facts are proved beyond a reasonable doubt:
    First: That the person, by force or threat of force, intimidated or interfered with, or attempted to intimidate or interfere with the persons named in the indictment, as charged;
    Second: That the person did so because of the race of those persons and because they were occupying a dwelling, and;
    Third: That the person did so knowingly and willfully.
