Cruel and unusual punishment

A penalty tantamount to torture, or excessive inproportion to the offense for which it is imposed, or inherently unfair, or bycontemporary standards shocking to people of reasonable sensitivity. Apunishment not inherently cruel and unusual may become so by the manner inwhich it is inflicted. Such punishment is prohibited by the Eighth Amendment tothe U.S. Constitution.
