Clear and present danger
In constitutional law, a standard used to determineif one's First Amendment right to speak may be curtailed or punished. If thewords are spoken in such circumstances and are of such a nature as to create aclear and present danger that they will bring about certain evils thatgovernment has a right to prevent, the government may prohibit or punish theuse of those words.
