Assault

An attempt or apparent attempt to inflict bodily injury upon anotherby using unlawful force, accompanied by the apparent ability to injure thatperson if not prevented. An assault need not result in a touching so as toconstitute a battery. Thus, no physical injury need be proved to establish anassault. An assault may be either a civil or criminal offense. Somejurisdictions have defined criminal assault to include battery -- the actualphysical injuring. Aggravated assault is an assault with a dangerous or deadlyweapon.
