 In order for someone to be found guilty of attempted escape the government must prove that the person the person was in the custody of [e.g., a Deputy United States Marshal] and that the person did something that was a substantial step toward escaping from custody. Mere preparation is not a substantial step toward committing the crime of attempted escape.
